Welcome to EzyStamp ("we", "our", or "us"). By accessing or using our platform at ezystamp.com, you agree to be bound by these Terms & Conditions. Please read them carefully before using our services.
1. Acceptance of Terms
By creating an account or using EzyStamp in any way, you confirm that you are at least 18 years old, have the legal authority to enter into this agreement, and agree to these terms in full. If you are using EzyStamp on behalf of a business, you confirm you have authority to bind that business to these terms.
2. Description of Service
EzyStamp provides a digital loyalty stamp card platform for businesses ("Merchants") and their end customers ("Customers"). Merchants can create, manage and distribute digital stamp cards; Customers can collect stamps and redeem rewards through those cards.
3. Merchant Accounts
As a Merchant, you are responsible for all activity that occurs under your account. You must provide accurate and complete information during registration and keep your login credentials secure. You may not share your account with others or use it for purposes other than operating your business loyalty programme.
4. Acceptable Use
You agree not to use EzyStamp to: engage in fraudulent activity; violate any applicable laws or regulations; harass, abuse or harm others; attempt to gain unauthorised access to our systems; or use automated tools to scrape or misuse the platform. We reserve the right to suspend or terminate accounts that violate these rules without notice.
5. Payments and Billing
Paid plans are billed in advance on a monthly or annual basis. All prices are in Indian Rupees (INR) and inclusive of applicable taxes where required by law. We use secure third-party payment processors and do not store your full card details. Failed payments may result in service suspension.
6. Free Trial
We offer a 14-day free trial on all paid plans. No credit card is required to start a trial. At the end of the trial, your account will revert to a read-only state unless you choose a paid plan. Trial accounts may have usage limitations.
7. Intellectual Property
EzyStamp and all associated technology, design, and content remain our exclusive intellectual property. You retain ownership of all content you upload (logos, business names, imagery). By uploading content to our platform, you grant us a non-exclusive licence to display and process that content solely for the purpose of providing the service to you.
8. Data and Privacy
Your use of EzyStamp is also governed by our Privacy Policy. You are responsible for ensuring you have the legal right to collect and store your customers' data through our platform, and for obtaining any necessary consents under applicable law.
9. Limitation of Liability
To the maximum extent permitted by law, EzyStamp shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, goodwill, or business interruption. Our total liability to you shall not exceed the total fees paid by you in the 12 months preceding the claim.
10. Modifications to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Continued use of EzyStamp after changes take effect constitutes acceptance of the revised Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Gujarat, India.
